ชะตากรรมป่าอาเจะห์ ภายใต้ความอ่อนแอของกฏหมายป่าไม้อินโดนีเซีย

 “พวกเราน่าจะช่วยกันวิเคราะห์ว่าจะเกิดอะไรขึ้นต่อการจัดการป่าไม้ ถ้าหากระเบียบกฎหมายของรัฐยังมีความไม่แน่นอน เพราะแม้แต่แผนที่ป่าไม้ในอินโดนีเซียก็ไม่เคยมีการทำร่วมให้เป็นแผนที่อันเดียวกัน ปัจจุบันแผนที่ป่าไม้จึงมี 4 เวอร์ชั่น ซึ่งแตกต่างกันมากเสียด้วย”

นี้คือข้อความที่ส่งมาจากอีเมล์ของ Afrizal Akmal นักกิจกรรมและนักเคลื่อนไหวจากองค์กรพัฒนาเอกชนแห่งหนึ่ง ถึง Muhammad Nizar Abdurrani ผู้ช่วยผู้อำนวยการวาลฮี อาเจะห์ สะท้อนปัญหาของการจัดการป่าไม้ของอินโดนีเซียได้อย่างตรงไปตรงมา

Afrizal Akmal ยังกล่าวอีกว่า ความรับผิดชอบต่อการเปิดพื้นที่ป่าไม้ไม่เคยมีอยู่ และปล่อยให้การแก้ไขปัญหาพื้นที่ป่าไม้ในแต่ละพื้นที่ยังดำเนินไปอย่างไร้การควบคุมดูแล เป็นไปได้ว่ามีการขโมยแปรรูปไม้โดยคนกลางในหน่วยงานปกครองจากส่วนกลางที่อยู่เบื้องหลังในการออกใบอนุญาต ซึ่งเป็นวิธีการแลกเปลี่ยนพื้นที่ป่าที่ง่ายและสะดวกในที่สาธารณะ เพราะไม่มีกฏเกณฑ์ในการตรวจสอบบัญชีป่าไม้อย่างครบถ้วน รวมทั้งเรื่องการจ่ายค่าใบอนุญาตการแปรรูปไม้ก็ไม่มีมาตรฐานที่แน่นอน

ในขณะที่ระเบียบกฎหมายและการบังคับใช้ยังเป็นที่สับสนอยู่ แต่ปรากฏว่า สำนักงานที่ดินแห่งชาติ จังหวัดอาเจะห์ ยังดำเนินการให้สัมปทานที่ดินอย่างต่อเนื่อง โดยปราศจากการตรวจสอบข้อเท็จจริงของพื้นที่ป่า และปรากฏว่ามีใบอนุญาตสัมปทานที่ดินมากมายถูกทิ้งจากบริษัท หลังจากการแปรรูปไม้และเปิดพื้นป่าเรียบร้อยแล้ว

 Afrizal Akmal กล่าวว่าภารกิจต่างๆ เกี่ยวกับการป่าไม้แทนที่จะอยู่ในหน่วยงานเดียวกัน กลับกระจัดกระจายและทำงานไม่ต่อเนื่องกัน ทั้งด้านการจัดทำแผนที่ การอนุมัติสัญญาเช่า การแลกเปลี่ยนที่ดิน แล้วเรื่องราวเหล่านี้ก็ไม่เคยถูกเปิดเผยต่อสาธารณะ นี้เป็นช่องว่างมโหฬาร และจะไม่สามารถรับมือกับปัญหาการบุกรุกทำลายป่าได้อย่างทันการณ์

 “เรายังพบอีกว่าระบบข้อมูลเกี่ยวกับภูมิศาสตร์ ไม่ได้ตั้งให้ถูกต้องตามกฎเกณฑ์ ดังนั้นจึงปรากฏมีการตีพิมพ์เอกสารปลอมโดยสำนักงานที่ดินแห่งชาติ ในเรื่องราคาของการทำประโยชน์ในที่ดินและค่าปรับจากการทำลายป่าก็ไม่มีความชัดเจน และไม่เคยเป็นที่รับรู้ของสาธารณะ นี่คือ เครื่องแสดงให้เห็นถึงกฏหมายป่าไม้กำลังถูกใช้เป็นเกมส์ หมายความว่า สถาบันของรัฐกำลังโกหกนั่นเอง”

สุดท้าย Afrizal Akmal ได้แสดงความสลดใจต่อวิสัยทัศน์เกี่ยวกับ “โครงการสีเขียว” ซึ่งเป็นโครงการของรัฐบาลอาเจะห์ เพื่อแก้ปัญหาป่าไม้ แต่ความจริงคือ วิสัยทัศน์สีเขียวนี้เป็นเพียงแค่การเปลี่ยนแปลงการจัดการการใช้ประโยชน์จากป่าไม้เท่านั้น

สำหรับสถานการณ์เกี่ยวกับการจัดการป่าไม้ในจังหวัดอาเจะห์นั้น หลังจากมีข้อตกลงสันติภาพและอาเจะห์ได้เป็นเขตปกครองตนเองภายใต้สาธารณรัฐอินโดนีเซีย ก็มีการเลือกตั้งรัฐบาลอาเจะห์อย่างเป็นประชาธิปไตย อาเจะห์ได้ออกกฎหมายป่าไม้ที่ดินของตนเอง ซึ่งมีความก้าวหน้าและสอดคล้องกับแนวทางในการปกครองตนเอง แต่ดูเหมือนว่าเกิดความผิดพลาดบางอย่าง เพราะรัฐบาลอาเจะห์ได้ใช้อำนาจดังกล่าวออกใบอนุญาตให้กับบริษัทเหมืองแร่และบริษัทปลูกพืชเศรษฐกิจ จนนำไปสู่การเปิดพื้นที่ป่า และทำลายป่าจำนวนมาก

ตามข้อมูลจากสำนักงานออกใบอนุญาต ของจังหวัดอาเจะห์ ในปี 2008 ได้บันทึกไว้ว่า มี 201 บริษัทที่มีสิทธิใช้ที่ดินสำหรับปลูกพืชเศรษฐกิจ ซึ่งรวมพื้นที่ทั้งหมด 540,839.955 เฮกต้าร์ หรือประมาณ 9.42 % ของอาณาเขตจังหวัดอาเจะห์ ซึ่งมีบริษัทหลากหลายประเภทที่ได้รับอนุญาตทำธุรกิจ เช่น บริษัทปาล์มน้ำมัน โกโก้ กาแฟ ยางพารา กล้วย ถั่วเหลือง ปศุสัตว์ การประมงและธุรกิจพืชผล พื้นที่ที่ใช้ทั้งหมดเป็นพื้นที่ป่าไม้ที่กระจายอยู่ทั่วไปในจังหวัดอาเจะห์

การขออนุญาตเข้าใช้พื้นที่ในยุคของการกระจายอำนาจค่อนข้างทำได้ง่าย เพราะคนจำนวนมากสามารถขอใบอนุญาตจากรัฐบาลท้องถิ่นได้โดยตรง ไม่ต้องไปยุ่งเกี่ยวกับหน่วยงานอื่น การขออนุญาตจากรัฐบาลกลางจาการ์ต้ามีความจำเป็นอยู่ประการเดียว คือกรณีพื้นที่ที่ขออนุญาตนั้นเป็นป่าคุ้มครอง แต่กฏเหล่านี้มีการฝ่าฝืนอยู่บ่อยๆ อย่างเช่น กรณีบริษัทปลูกปาล์มน้ำมันได้รับสัมปทานเปิดพื้นที่ในป่าพรุตรีป้า

“ป่าพรุตรีป้าเป็นส่วนหนึ่งของเขตนิเวศวิทยาเลอูเซอร์ มีเนื้อที่ทั้งหมด 2.5 ล้านเฮกต้าร์ ซึ่งเป็นส่วนหนึ่งของพื้นที่ยุทธศาสตร์แห่งชาติ เป็นที่ที่ต้องขออนุญาตจากรัฐบาลกลางจาการ์ต้า แต่บริษัทที่ได้รับอนุญาต มีเพียงรัฐบาลท้องถิ่นเป็นผู้ออกใบอนุญาตให้เท่านั้น เพื่อให้บริษัทเข้าไปเปิดป่าสำหรับปลูกปาล์มน้ำมัน เป็นเรื่องที่น่าเศร้าแต่มันเป็นเรื่องจริง” Muhammad Nizar Abdurrani ผู้ช่วยผู้อำนวยการวาลฮี อาเจะห์กล่าวด้วยน้ำเสียงราบเรียบ เหมือนเรื่องที่เกิดขึ้นเป็นเรื่องปกติของจังหวัดอาเจะห์

 การพัฒนาการปลูกพืชเศรษฐกิจเชิงเดี่ยวเพื่อการผลิตไม้นั้น ถูกทำให้เข้าใจว่าจะเป็นการสร้างป่า แต่ในความเป็นจริงกลับกลายมาเป็นส่วนหนึ่งของสาเหตุการทำลายป่า เพราะการให้สัมปทานที่ดิน ให้สิทธิในการใช้ที่ดินแก่เอกชนเพื่อปลูกพืชเศรษฐกิจเชิงเดี่ยว เป็นการทำหลายความหลากหลายทางชีวภาพ สร้างความเสื่อมโทรมแก่ระบบนิเวศ และที่สำคัญนำมาซึ่งความขัดแย้ง โดยพบว่าหลายพื้นที่เป็นกระบวนการแย่งชิงที่ดินทำกินไปจากมือของคนท้องถิ่นที่ทำกินอยู่เดิม

เกี่ยวกับระบบนิเวศป่าพรุที่มีอยู่มากในอาเจะห์ ป่าพรุเป็นระบบนิเวศพิเศษ เป็นพื้นที่ชุมน้ำที่ทำหน้าที่สำคัญมากมายในทางนิเวศวิทยา ทั้งการควบคุมความสมดุลของภูมิอากาศ ป้องกันน้ำท่วมและความแห้งแล้ง ป่าพรุควรถูกดูแลไว้เป็นกันชนสำหรับพื้นที่รอบๆที่ถูกแปรสภาพเข้าสู่การปลูกพืชเศรษฐกิจ โดยเฉพาะพืชเศรษฐกิจปาล์มน้ำมัน พบว่าบริษัทได้ขุดคลองในป่าพรุ เพื่อระบายน้ำออกจากป่า เมื่อถูกแปรสภาพมาสู่สวนพืชเศรษฐกิจ ส่งผลให้ป่าชุ่มน้ำในอาเจะห์กำลังลดน้อยถอยลงอย่างรวดเร็ว

พื้นที่ที่เป็นป่าชุ่มน้ำหรือป่าพรุนั้น เป็นเป้าหมายสำคัญของการปลูกปาล์มน้ำมัน ยกตัวอย่าง ป่าพรุที่กำลังประสบปัญหาอยู่ในขณะนี้ นั่นคือ ป่าพรุตรีป้า ซึ่งเป็นหนึ่งป่าพรุในอาเจะห์ที่กำลังเข้าสู่ขั้นวิกฤต แม้ว่าปัจจุบันป่าพรุตรีป้าจะอยู่ในเขตนิเวศวิทยาเลอูเซอร์ (Leuser Ecosystem) แต่ป่าพรุตรีป้าก็ยังไม่ได้รับสถานะอย่างเป็นทางการว่าเป็นพื้นที่คุ้มครอง ความอ่อนของสถานะทำให้บางบริษัทได้รับการสัมปทานปลูกปาล์มในพื้นที่นี้ และแม้ว่าปัจจุบันในพื้นที่สัมปทานบางแห่งจะยังไม่มีการปลูกปาล์มน้ำมัน แต่ก็มีการวางแผนเพื่อเปิดป่าอย่างต่อเนื่อง ซึ่งวาลฮี อาเจะห์ ได้เรียกร้องให้รัฐบาลอาเจะห์หยุดการออกใบอนุญาตในการปลูกพืชเศรษฐกิจใหม่ ตรวจสอบพฤติกรรมของบริษัทอย่างทันที และประเมินผลการออกใบอนุญาตปลูกพืชเศรษฐกิจที่ผ่านมา คืนสิทธิให้แก่คนพื้นเมือง การประกาศระงับชั่วคราวการทำไม้ซุง และให้ปิดการขอใบอนุญาตใหม่ ฟื้นฟูพื้นที่ป่าที่ได้รับความเสียหายจากการทำลายอย่างขาดความละอายของบริษัทและหน่วยงานราชการของรัฐบาลอาเจะห์ ที่ร่วมกันทำอาชญากรรมต่อป่าไม้

มูลนิธิเลอูเซอร์สากลและองค์กรพืชและสัตว์พื้นเมืองอินโดนีเซีย(Leuser International Foundation and Flora Fauna Indonesia) เปิดเผยข้อมูลความเสียหายว่า  จากปี 2006-2012 อัตราการทำลายป่าไม้ในอาเจะห์มากถึง 23,124.41 เฮกต้าร์ ต่อปี นี่เป็นเพียงความเสียหายค่าเฉลี่ยจากป่าไม้ในอาเจะห์ทั้งหมด ป่าไม้ที่ถูกทำลายมากที่สุดต่อปี ปรากฏอยู่ในอำเภอซูบูลุสซาลาม (Subulussalam) ถึง 3,946.92 เฮกต้าร์ อำเภอนากันรายา (Nagan Raya) 2,581.90 เฮกต้าร์ และกาโยลูเอส (Gayo Lues) 2,064 เฮกต้าร์ พื้นที่เหล่านี้เป็นอำเภอที่เพิ่งได้รับอำนาจในการปกครองตนเองใหม่ (Autonomous)  มีขอบเขตป่าไม้อย่างชัดเจน แต่เนื่องจากว่าได้รับผลกระทบจากยุคการปกครองตนเอง ส่งผลให้บริษัทได้รับใบอนุญาตจากรัฐบาลท้องถิ่นโดยง่ายและโดยตรง

“ถ้าหากว่ามีความเสียหายอย่างต่อเนื่อง ผลกระทบจากภัยพิบัติทางธรรมชาติจะขยายความรุนแรงเพิ่มขึ้นในอนาคต ในข้อเท็จจริง องค์กรด้านสิ่งแวดล้อมของสหประชาชาติ United Nations for Environment Program (UNEP) ได้มีการทำนายไว้อย่างน่าตกใจว่า ถ้าการทำลายป่าไม้ในเกาะสุมาตรา และกาลิมันตันยังมีความต่อเนื่องจนถึงปัจจุบัน อุรังอุตังจะสูญพันธุ์ภายใน 15 ปี” Muhammad Nizar Abdurrani กล่าวเน้นย้ำคำทำนายของ UNEP น้ำเสียงเต็มไปด้วยความกังวล

ผู้ช่วยผู้อำนวยการวาลฮี อาเจะห์ ยังกล่าวเพิ่มเติมว่าความไม่แน่นอนของคำนิยาม คำว่าป่าไม้ในกฏหมายต่างๆ กฏหมาย No.41/2009 กฏระเบียบของรัฐ No.44/2004 กฤษฏีกากรมป่าไม้ No. 32/2001 และกฏระเบียบของกรมป่าไม้ No.50/2009 ซึ่งแสดงความหมายชัดเจนในเรื่องการกำหนดอำนาจระหว่างพื้นที่ป่าส่วนกลาง และพื้นที่ป่าที่เกี่ยวข้องกับแผนพัฒนาเชิงพื้นที่ของจังหวัด แต่กฏหมายป่าไม้ของอินโดนีเซียมีจำนวนมาก และซับซ้อน ทำให้มีการฝ่าฝืนทั้งโดยตั้งใจและไม่ได้ตั้งใจอยู่บ่อยๆ

Dewa Gumay นักกิจกรรมด้านสิ่งแวดล้อมอีกคนหนึ่งเปิดเผยว่า ความจริงพื้นที่ที่อยู่ในการปฏิบัติการทำป่าไม้ในอาเจะห์มันทับซ้อน ยกตัวอย่างเช่น มุมมองของสถาบันการทำป่าไม้ กรมการเกษตร กรมการเหมืองแร่ และอื่นๆ ซึ่งหากมองลงไปในพื้นที่หรือจุดมุ่งหมาย ก็ค่อนข้างมีความแตกต่างกันโดยสิ้นเชิง เรื่องของป่าไม้ขึ้นตรงต่อสถาบันการทำป่าไม้ ที่มีหน้าที่ในการปกป้องป่าที่มีบทบาทเหมาะสมเฉพาะประเด็นของป่าไม้ ส่วนกรมการเหมืองแร่มีบทบาทในประเด็นธรณีวิทยาและการสงวนแร่ สำนักงานสวนป่าเศรษฐกิจดูแลเรื่องแผนที่ รวมทั้งแผนที่ของที่ดินเพื่อบริโภคและที่อยู่อาศัย มีหลายกรณีหลังจากได้รับการอนุมัติใบอนุญาต และนำไปใช้การลงทุนที่มีความน่าสงสัย ไม่ชัดเจน เพราะขั้นตอนอนุมัติมันทับซ้อนกัน

กรณีตัวอย่างที่ป่าพรุตรีป้า ที่บริษัทคาลิตาอาลัม (Kalista Alam) ได้รับใบอนุญาตปลูกพืชเศรษฐกิจในพื้นที่ป่าพรุ หน่วยงานที่เกี่ยวข้องมีความเห็นที่แตกต่างกัน ระหว่างกรมการพืชสวนเศรษฐกิจ กรมการป่าไม้ กรมพืชสวนเศรษฐกิจ เริ่มจากว่าที่ดินที่ได้รับสัมปทานนั้น ไม่ได้อยู่ในเขตป่าไม้ ขณะที่กรมการป่าไม้พูดแตกต่างออกไป ว่าพื้นที่นี้ถูกรวมเข้ากับป่าไม้ที่อยู่ในเขตป่าคุ้มครองแล้ว ในที่สุดสิ่งเหล่านี้ก็กลายมาเป็นกฏหมายที่ไม่ชัดเจน และเป็นช่องว่างให้ผู้เข้าใช้ประโยชน์ได้โดยไม่รู้สึกว่ากำลังฝ่าฝืนกฏหมาย

เมื่อมองไปที่ผลกระทบทางเศรษฐกิจที่เกิดจากการทำลายป่าไม้ พบว่าการทำลายป่าไม้นั้น ทำให้สูญเสียทรัพยากรธรรมชาติ และศักยภาพของป่าไม้ ซึ่งอาจจะเป็นไม้หรือสัตว์ สิ่งของอื่นๆ ที่มีมูลค่าทางเศรษฐกิจสูง จะส่งผลต่อเศรษฐกิจท้องถิ่นโดยตรง เพราะป่าเคยเป็นแหล่งที่มาของรายได้ของคนในท้องถิ่นนั่นเอง

ถึงแม้จะไม่มีข้อมูลอย่างเป็นทางการที่จะคำนวณยอดความเสียหายที่เกิดจากการทำลายป่าและความเสียหายของที่ดินในอาเจะห์ในแต่ละปี แต่จากการประมาณการของความเสียหายจากฐานทั่วๆไป เช่น บนฐานประเมินการใช้ที่ดินและป่าไม้ หรือการทำลายป่าไม้ที่ไม่ใช่การแปรรูปไม้หรือผลิตภัณฑ์ต่างๆ เช่น ประเมินจากการฟื้นฟูทำให้ป่าคืนสู่สภาพปกติ ประเมินความเสียหายจากโครงสร้างพื้นฐาน และความสูญเสียของการท่องเที่ยวเชิงอนุรักษ์ ในแต่ละปีก็มีมูลค่ามหาศาล

ประเด็นท้าทายที่อยู่เบื้องหน้ารัฐบาลท้องถิ่นแห่งเขตการปกครองพิเศษ อาเจะห์ ณ ปัจจุบันก็คือ จะกำหนดทิศทางการพัฒนาอย่างไรที่จะเกิดความสมดุล ความเป็นธรรมและความยั่งยืนของการใช้ทรัพยากรธรรมชาติ ขณะที่รัฐบาลอาเจะห์กำลังเพลิดเพลินอยู่กับรายได้จากการให้สัมปทานที่ดินป่าไม้เพื่อการปลูกพืชเศรษฐกิจโดยนักลงทุนรายใหญ่จากในและต่างประเทศ ปรากฏฐานทรัพยากรถูกทำลายลงไปเรื่อยๆ จนเกิดปัญหามลพิษ ปัญหาความแปรปรวนของสภาพอากาศ และความขัดแย้งทางสังคมก็ก่อตัวชัดเจนขึ้นเรื่อยๆ นั้นแสดงว่ารัฐบาลอาเจะห์ต้องเกิดกระบวนการคิดครั้งใหญ่ทั้งการปรับปรุงนโยบายและกฎหมายให้ทันต่อการรองรับความเปลี่ยนแปลงที่กำลังจะมาถึง

Dr.M.Nasir อาจารย์ภาควิชาเศรษฐศาสตร์สิ่งแวดล้อมจากมหาวิทยาลัยเชียะห์คัวลา (Syiah kuala, Banda Aceh) กล่าวว่า การลงทุนภาคเอกชนทางด้านพืชเศรษฐกิจกำลังเติบโต การลงทุนที่เล็งไปที่การแสวงหาการเติบโตเพียงอย่างเดียว อาจจะเป็นผลด้านลบต่อสิ่งแวดล้อม ควรจะมีการจัดสมดุลใหม่ให้มีความพอดีระหว่างการพัฒนาทางเศรษฐกิจและการรักษาสภาพแวดล้อม และยังจะต้องคำนึงถึงการคงอยู่การอยู่ได้ของเศรษฐกิจและสวัสดิการของชุมชนท้องถิ่นซึ่งดำรงอยู่ได้โดยการใช้ทรัพยากรธรรมชาติเป็นฐานดำรงชีพ การทำลายฐานทรัพยากรที่ดินป่าไม้ก็จะส่งผลกระทบต่อเศรษฐกิจชุมชนโดยตรง 

Usman Hamid จาก Co-Founder Change Org Indonesia เคยกล่าวไว้ว่า ผลกระทบจริงๆ อาจจะเกิดขึ้นในอีก 5-10 ปีข้างหน้า ตอนนี้สังคมอาจจะกำลังสนุกเพลิดเพลินอยู่กับผลของการลงทุนในระยะแรก แต่มีความจำเป็นต้องให้การศึกษาแก่ประชาชาชน ให้ทราบถึงความสูญเสียที่จะเกิดขึ้นในอนาคตด้วย

ข้อมูลจาก Imam Syuja ผู้นำชุมชนในอาเจะห์ ซึ่งเคยเป็นสมาชิกของคณะกรรมการการทำป่าไม้ รัฐสภา บอกว่า ผลการจัดการป่าไม้ในแผนพัฒนาเชิงพื้นที่ของอาเจะห์ ประชาชนคนท้องถิ่นได้รับที่ดินเพียง 1 % หรือประมาณ 14,704 เฮกต้าร์ แต่อีก 1 ล้านเฮกต้าร์เป็นของการทำเหมืองแร่ ไม้ซุง และสัมปทานน้ำมัน ในความคิดของตนนั้น รัฐบาลอาเจะห์ควรจะมุ่งไปที่ที่ดินเพื่อการเกษตรกรรม เพื่อที่จะได้มีผลผลิตออกมาจำนวนมาก

ผืนป่าที่อุดมสมบูรณ์ของอาเจะห์ที่เคยเป็นฐานของอาณาจักรโบราณและหล่อเลี้ยงประชากรอาเจะห์ให้อยู่รอดมาถึงปัจจุบันกำลังถูกท้าทายอย่างหนักจากการรุกเข้ามาของธุรกิจปลูกสร้างแปลงพืชเศรษฐกิจขนาดใหญ่ เช่นเดียวกันกับประเทศด้อยพัฒนาทั้งหลายในโลกยุคใหม่ที่การใช้ประโยชน์จากทรัพยากรเปลี่ยนมือไปและถูกลดทอนให้เสื่อมโทรมลงจนมีปัญหาทางนิเวศวิทยาและปัญหาสังคมตามมามากมาย  ท่ามกลางความสับสนไร้มาตรฐานของระเบียบกฎหมายและความอ่อนแอไร้ความเป็นธรรมของการบังคับใช้  ป่าฝนเขตร้อนสำคัญของโลกผืนนี้ที่รัฐบาลอินโดนีเซียภาคภูมิว่าเป็น “ปอดของโลก” กำลังอยู่ในความเสี่ยงอย่างสูงต่อการสูญเสียไปเพื่อสังเวยกิเลสอันไม่รู้จบสิ้นของระบบเศรษฐกิจทุนนิยม

Land and Forest in Aceh...Ruayrin Pedsalabkaew

Destiny of Aceh’s Forestry under the Weakness of Indonesian Forest Law

“We must act together likely analyzing towards what is happening to forestry management. There is dilemma of government’s regulations due to the fact that the Indonesian forestry maps scatted. While regulations and its enforcement are confusing, the National Land Office in Aceh Province is continuing opened for lands concession without any checks for accuracy.  Unfortunately, many lands concession licenses have been left after timbers logging operated.

 Afrizal Akmal stressed that forestry management missions must be established and located in one institute due to well-management and effectiveness instead disrupted arrangements. Accordingly, forestry mapping, concession licenses, lands occupation must be at one organization. All of these seem to be a greater hole of administration, which has never been revealed to publicity. As well as forestry encroachment will become big trouble to be handling by Indonesia government.

 “We found that geographical data systems has been formulating incorrect according to its regulations. As the results, fake documents are published by National Land Office. In addition, lands use payment and encroachments fined are also unclear and unknown in public. It seems that government agencies have played on forestry regulation, and they are liars.

Finally, Afrizal Akmal mentioned to mission of “Green Project” which is a part of Aceh Government‘s Project toward forestry problems resolutions. In reality, there is displacing lands and forestry management instead problems solution achievements.

After Aceh has been free and agreed to be autonomous under the Indonesian government, Aceh Province has committed to provincial selection democratically. As the results, Aceh Province itself has established their own forestry and lands regulations, which is possibly in advance and suitable for autonomous government. However, mistakes are generating through using power exercise particular the Aceh’s government. Obviously, providing companies concession licenses on mining and plantation, leading to forest encroached and destroyed.

According to Aceh Provincial Licenses Admission Office, in 2008, 201 companies owned rights to access and use lands for cash crops plantation. The concession areas were covered 540,839.955 hectares or it was 9.42 % of total areas in Aceh Province. In fact, many various companies have been licensed for forestry business such plantation of palm, cocoas, coffees, rubber trees, bananas, soy beans, livestock, aquaculture, and orchard business. All of plantation lands are separately located across Aceh Province.  

In the fact, licenses are easily certified for lands utilization under decentralized era.  It shows that local government can directly approve firms who wish to access lands at one official process. In fact, the Jakarta’s central government responds to verify and approve license to only particular conservation areas. However, law violation by firms are exist and remaining likely  Palm Company gets lands use license to access and operate areas covered Tripa swamp forest.

“Regarding Tripa swamp forest is a part of Leuser Ecology Zone, and its total areas are  2.5 million hectares, where is located in a part of National Strategic Areas.  In this case, lands concession must be directly approved and certified by only the central government in Jakarta. Currently, existing palm company gets license to access lands via local government instead. This is abnormal serious circumstance but it seems normal phenomena taken place over lands of Aceh”, said Muhammad Nizar Abdurrani, the deputy director of WALHI Aceh.

Regarding swamp forest ecology systems, there are many remains in Aceh Province. Swamp forest is a special watershed ecologically systems, it is a key factor to climate equilibrium controls mechanism, including floods and drought protection. Actually, swamp forest must be established scoping for specific land and forest as buffer zone for surrounding areas instead of being cleared for mono-crops plantation particular palm business. It found that the company has internal canal dig along with swamp forest in order to drain some water out of planted areas. Seriously, watershed areas coverage in Aceh Province has been rapidly decreased.

Recently, swamp forest or watershed areas are mainly targeted for palm plantation business. Unluckily, Tripa swamp forest is now facing through forest encroachment event it is located in particular Leuser Ecosystem Zone. In spite of locating in Leuser Ecosystem Zone, officially protection areas have not been in secured as deserved. Weakness of officially security leads the concession companies to take advantages on special lands. While some lands use concession is not being planted palm trees yet, it will be opened continuously in very soon. In practice, the WALHI Aceh exercises to demand for Aceh’s government to stop certifying license the new cash crops plantation investment. It also demands for promptly checking on company performance as well as to assess results of palms plantation certification in the past. Moreover, returns local people rights of ownerships to access and control over their lands, declares to shut temporary timber logging down, stops new license approval, and revitalizes degraded forestry from particular companies and the Aceh’s government, who have committed criminal ashamedness to the forest.     

According to Leuser International Foundation and Flora Fauna Indonesia, since 2006-2012, damages of forestry have been caused. The average figures of total forest areas in Aceh Province up to 23,124.41 hectares in annual. In fact, forest areas are located in Subulussalam District have been ruined up to 3,946.92 hectares, followed by Nagan Raya District is seen 2,581.90 hectares, and Gayo Lues District is covered 2,064 hectares. All of these areas just being in autonomous districts, where forestry areas coverage is clearly located. “ If there is continuing damages, natural disasters will greater impacts in the future. In fact, United Nations for Environment Program (UNEP) has projected that within fifteen years if there is continuing deforestation in Sumatra Island as well as Kalimantan Island up to date, the orangutan will have been in extinction”, said Muhammad Nizar Abdurrani, as re-emphasized to UNEP projected with worry tone.   

Besides, the deputy director of WALHI Aceh also stressed that there is uncertainty of forest definitions in various regulations. In fact, it has found through specified documents No.41/2009, government regulation No.44/2004, and forestry department decree No. 32/2001, as well as forestry department regulation No.50/2009.  All has clearly identified authority of central government and provincial government as local government to make decision on forest areas, including provincial developed forest areas plan. Dewa Gumay is an environmental activist revealed that there is overlapping areas of timber logging in Aceh Province. According to forest plantation department, the concession land was not located in forestry areas while forestry department explained that particular areas have already been in conservation forest. Eventually, its conclusion is dealing with unclear regulations, which shown a big gap for advantaged firms who is intended committing law violation.

Based on economic aspect, deforestation has caused natural resources damages, including forestry capacity, where likely high valuable plants or animals exist. It is directly affected to local economic where income source is generating and derived from forest products.

Even though, unofficially deforested and land degraded damages cost in Aceh Province not being presented, assessments of any basic related foundations have been taking into account.   Lands use and forestry areas, timber and non timber products, forestry restoration, infrastructure and eco-tourism are based to assessment. Actually, there are invaluable costs to all relevant forestry and land degradation in annual.   

There are some challenges which the autonomous Aceh’s government has been facing through. In fact, sustainability and fairness of natural resources utilization must be addressed and achieved development planning direction. While the Aceh government is pleasures with greater incomes and benefits from concession through huge domestic and foreign investors,   resources base has been gradually destroying and polluting, climate changing, as well as conflict disputes clearly occurring.  As the results, the Aceh’s government must review and reconsider in order to play policies and regulations development towards rapid change in locally.  

Dr.M.Nasir is lecturer at faculty Economic Environment, Syiah kuala University in Aceh Province said that cash crops investment has been growth. Moreover, attention to only growth investment will be affected to negative environment aspect. Equality of development should be met between economic and environment concerns as well as existence of communities economic and its welfare must be taking into account. Practically, communities have relied on surrounding forest and lands resources. If it has been harm and destroyed, domestic economic destruction will come over directly. 

Usman Hamid from Co-Founder Change Organization Indonesia has stressed that the real impacts will be hitting within next 5-10 years ahead. At the first stage, society seems enjoy great benefits from investment, however, future damage of deforestation must be informing and educating to people as well.

Imam Syuja, who is leader of Aceh community and was, being member of timber logging commission in parliament, said that there is Aceh’s forestry management in spatial development plan. Besides, forestry is allocated for local people only 1 % or approximate 14,704 hectares, which other one million hectares is assigned for mining, timber logging, and oil concession. In his opinion, the Aceh’s government should play attention and focus on lands use for agriculture in order to produce on mass production.

Unfortunately, lands of Aceh is fertility, where is located for a basic grounded to ancient kingdom and greater feed to Aceh people,  will be facing and challenging to huge invasive plantation business as similar to less developed countries around the world. In the midst of consumed and non-standardized law, and weakness of equality laws enforcement, forest are destroyed and lands ownerships are competitive and relocated, ecological and social problems are taken places. In particular, tropical rain forest, where the Indonesian government is so proud to declared as “Lung of the World” as being in high risky to a greedy capitalism investors in the timing.  

It is a big question to be addressed by Aceh people, local government, and Indonesian government. In order to make governance and effective policies and regulations as well as equity of rule of law, people must be capable to handle with rapidly destructive trend surrounded.
