สิทธิชุมชนถูกละเมิด เมื่อบริษัทปาล์มน้ำมันข้ามชาติบุกป่าอาเจะห์

การเข้าครอบครองทรัพยากรที่ดินของกลุ่มทุนข้ามชาติขนาดใหญ่ในพื้นที่ป่าเพื่อปลูกพืชเศรษฐกิจแปลงขนาดใหญ่ โดยการอำนวยความสะดวกของรัฐที่จังหวัดอาเจะห์ ส่งผลให้คนในท้องถิ่นเข้าใช้ประโยชน์จากที่ดินได้ยากขึ้น  และคนท้องถิ่นที่เคยใช้ประโยชน์ในทรัพยากรที่ดินอยู่ก่อนหน้า ก็ถูกขับไล่ออกจากพื้นที่ แตกต่างไปจากเดิมที่คนในท้องถิ่นสามารถเข้าถึงทรัพยากร ผ่านกติกาของชุมชนในหลากหลายรูปแบบ ทั้งการสืบทอดมรดกจากบรรพบุรุษ และการจัดการภายใต้ขนบธรรมเนียมประเพณีดั้งเดิม

มีหลายกรณีที่เกิดความขัดแย้งยืดเยื้อเป็นคดีอยู่ในศาล หลายกรณีได้ขยายตัวเป็นความรุนแรง ทั้งการชุมนุมประท้วง ถึงขั้นการทำลายทรัพย์สิน อย่างไรก็ดี ปฏิกิริยาที่ชาวชุมชน คนพื้นเมืองแห่งอาเจะห์กำลังแสดงออกนั้น เป็นตัวสะท้อนถึงความลำเอียงของนโยบาย และความไม่เป็นธรรมทางโครงสร้างทางการเมือง เศรษฐกิจและสังคมที่ดำรงอยู่ได้เป็นอย่างดี

ในจังหวัดอาเจะห์ จังหวัดเดียว มีบริษัทปาล์มน้ำมันทั้งหมด 51 บริษัท ซึ่งมีหลายบริษัทได้รับสัมปทานที่มากกว่า 1 แปลง อย่างบริษัทเปอร์เคอบูนาน นูซันตารา 1(PT. Perkebunan Nusantara 1) ได้รับสัมปทานที่ดินถึง 13 แปลง (http://2012.acehinvestment.com/Perusahaan-PMDN.html)

ต่อไปนี้ คือ หนึ่งตัวอย่าง กรณีความขัดแย้งที่เกิดจากบริษัทข้ามชาติจากประเทศมาเลเซีย มีความขัดแย้งเรื่องที่ดินกับชุมชนในบริเวณที่บริษัทได้รับสัมปทานที่เพื่อปลูกปาล์มน้ำมัน ในพื้นที่ อำเภออาเจะห์ซิงกิล (Aceh Singkil) พรมแดนทางทิศเหนือติดกับอำเภอซูบูลูสซาลาม (Subulussalam) ทางทิศใต้ติดกับมหาสมุทรแปซิฟิก ทางทิศตะวันออกติดกับจังหวัดสุมาตราเหนือ และทางทิศตะวันตกติดกับตำบลทรูมอน (Trumon) อำเภออาเจะห์เซอลาตัน (Aceh Selatan) เมื่อก่อนอำเภออาเจะห์ซิงกิลเป็นส่วนหนึ่งของอำเภออาเจะห์เซอลาตัน แยกตัวออกมาตามกฏหมาย No.14/1999 ซึ่งพื้นที่เกือบทั้งหมดอยู่ในเขตอุทยานแห่งชาติเทือกเขาเลอูเซอร์ (Gunung Leuser National Park) มีทั้งส่วนที่เป็นแผ่นดินและหมู่เกาะ อำเภออาเจะห์ซิงกิล มีทั้งหมด 11 ตำบล ซึ่งมีทั้งหมด 120 หมู่บ้าน

ส่วนที่เป็นแผ่นดิน เป็นที่สัมปทานสำหรับทำไม้ซุงซึ่งได้แปรสภาพป่าและป่าพรุอันอุดมสมบูรณ์  เปลี่ยนแปลงไปอย่างไม่มีใครคาดคิดมาก่อน

ในปัจจุบันมีการพัฒนาการเพาะปลูกเพื่อส่งออกสินค้าขนานใหญ่ อย่างเช่น น้ำมันปาล์ม โกโก้ กระดาษ และพืชเศรษฐกิจอื่นๆ จำพวกมะพร้าว หมาก ขิง ชาดำ ฝ้าย อ้อย พืชน้ำมันหอม กระวาน และอื่นๆ ในระหว่างพืชที่ปลูกทั้งหมด ปาล์มน้ำมันเป็นพืชที่ทำรายได้ให้กับอาเจะห์ซิงกิลมากที่สุด เพราะว่ามีความเหมาะสมกับสภาพและประเภทของดินในอาเจะห์ซิงกิล

และเนื่องด้วยอาเจะห์ซิงกิลเป็นอำเภอใหม่ ยังมีที่ดินที่ยังไม่ได้ใช้งานอีกจำนวนมาก มีการเข้าไปสำรวจเพื่อปลูกพืชเศรษฐกิจ และก่อสร้างสำนักงานโดยรัฐบาล บริษัทเอกชน ในที่ดินที่ผ่านการตรวจสอบแล้ว ซึ่งบริษัทเอกชนส่วนใหญ่ใช้ปลูกปาล์มน้ำมันและการลงทุนสำหรับก่อสร้างโรงงานสกัดน้ำมันปาล์ม

Rusliadi จากองค์กรพัฒนาเอกชน เครือข่ายสิทธิชุมชนและคนพื้นเมือง ให้ข้อมูลว่า เฉพาะที่อำเภออาเจะห์ซิงกิล มีบริษัทปลูกสร้างสวนปาล์มถึง 7 บริษัท พื้นที่ที่บริษัทลงไปปลูกปาล์มในอำเภออาเจะห์ซิงกิลดังนี้

-บริษัท Socfindo ได้รับสัมปทานที่ดินในตำบล Gunung Meriah 4,414.18 เฮกต้าร์ ซึ่งปลูกปาล์มไปแล้ว 4,210 เฮกต้าร์

-บริษัท Lemban Bakit ได้รับสัมปทานที่ดินในตำบล Singkil Utara 6,570 เฮกต้าร์ ซึ่งปลูกปาล์มไปแล้ว 5,923 เฮกต้าร์

-บริษัท Delima Makmur ได้รับสัมปทานที่ดินในตำบล Danau Paris 12,173.47 เฮกต้าร์ ซึ่งปลูกปาล์มไปแล้ว 8,969 เฮกต้าร์

-บริษัท Ubertraco ได้รับสัมปทานที่ดินในตำบล Kota Baharu 13,924.68 เฮกต้าร์ ซึ่งปลูกปาล์มไปแล้ว 5,869 เฮกต้าร์

-บริษัท Lestari Tunggal Pratama ได้รับสัมปทานที่ดินในตำบล Danau Paris 1,861 เฮกต้าร์ ซึ่งปลูกปาล์มน้ำมันไปแล้ว 1,200 เฮกต้าร์

-บริษัท Telaga Zam-zam  ได้รับสัมปทานที่ดินในตำบล Gunung Meriah 100.05 เฮกต้าร์ ซึ่งปลูกปาล์มไปแล้วทั้งหมด

-บริษัท Jaya Bahni Utama ได้รับสัมปทานที่ดินในตำบล Danau Paris 1,800 เฮกต้าร์ ซึ่งปลูกปาล์มไปแล้วทั้งหมด

ในปี 1986 บริษัทบริษัทอูเบอร์ตราโช (Ubertraco) ซึ่งมี Tengku Muslim ชาวบ้านจาก ตำบลทรูมอน อำเภออาเจะห์เซอร์ลาตัน เป็นเจ้าของ เขาเริ่มปลูกพืชเศรษฐกิจปาล์มน้ำมันโดยเริ่มจากตำบลซิมปังคีรี (Simpang Kiri) แต่มีบางอย่างไม่ปกติ

ต่อมาในปี 1988 บริษัทบริษัทอูเบอร์ตราโช ได้รับหนังสือรับรองการสัมปทานที่ดิน No.1/1988 เนื้อที่ 10,917 เฮกต้าร์ ในตำบลโกตาบาหะรู (Kota Baharu) ,กูนุงเมอเรียะห์ (Gunung Meriah), ซิงกิลอุตารา (Singkil Utara) และ ซิงกิล (Singkil) อำเภออาเจะห์ซิงกิล หลังจากนั้น 6 ปี ประมาณปลายปี 1994 บริษัทบริษัทอูเบอร์ตราโช ก็ได้รับหนังสือรับรองการสัมปทานที่ดินเป็นฉบับที่ 2 No.2/1994 เนื้อที่ 3,000 เฮกต้าร์ ห่างประมาณ10 กิโลเมตรจาก ตำบลโกตาบาหะรูและซิงโคโฮร์ (Singkohor) อำเภออาเจะห์ซิงกิล

ในวันที่ 10 เดือนพฤศจิกายน 1998 บริษัทอูเบอร์ตราโช ได้สับเปลี่ยนธุรกิจให้กับ Haji Muhammad Sobri นักธุรกิจจากประเทศมาเลเซีย เพราะในขณะที่ถือใบอนุญาตสัมปทานอยู่นั้น บริษัทอูเบอร์ตราโชไม่สามารถทำงานได้เต็มที่ ทั้งเรื่องของการจัดการและการเพาะปลูก ส่งผลให้ที่ดินถูกทิ้งร้างไปเป็นปี

ต่อในปี 1998 เกิดประเด็นของความขัดแย้งเรื่องที่ดินระหว่างชุมชนกับบริษัท มีปัญหาเรื่องเอกสารสิทธิ์ทับซ้อนกันกับของบริษัท ความไม่ชัดเจนของเส้นเขตแดนของที่ดินสัมปทาน ที่ดินร้าง ที่ดินสัมปทานรวมอยู่กับที่ดินชุมชน แม้กระทั่งหน่วยงานของรัฐ ค่ายทหาร สถานกักกัน ถนน ชุมชน และอื่นๆอีก ก็ตั้งอยู่ในที่ดินที่บริษัทได้รับสัมปทาน

ในปี 2006 ได้มีการเดินขบวนเคลื่อนไหวในที่สาธารณะเพื่อเรียกร้องให้สภาอำเภอ สำนักงานที่ดินแห่งชาติ และสำนักงานที่ว่าการอำเภออาเจะห์ซิงกิลแก้ปัญหาที่เกิดขึ้น ชุมชนได้ถามต่อบริษัทอูเบอร์ตราโชว่า ใครเป็นคนเริ่มเข้ามาในที่ดินของชุมชน พวกเขาต้องการความชัดเจนในเรื่องเขตแดนระหว่างที่ดินของชุมชนและที่ดินที่บริษัทได้รับสัมปทาน

ในปี 2007 สภาจังหวัดได้เชิญตัวแทนจากชุมชนที่ขัดแย้งกับบริษัท เพื่อไกล่เกลี่ยแก้ปัญหาที่ขัดแย้งกันระหว่างชุมชนกับบริษัทอูเบอร์ตราโช ในการประชุมคราวนั้นได้เชิญหัวหน้าสำนักงานที่ดินแห่งชาติ จังหวัดอาเจะห์ด้วย ตัวแทนฝ่ายชาวบ้านคือ Safar Siregar ถามเกี่ยวกับการออกหนังสือรับรองสัมปทานที่ดินของบริษัทอูเบอร์ตราโช

“ทำไมสำนักงานที่ดินแห่งชาติ จังหวัดอาเจะห์ ถึงออกหนังสือรับรองสัมปทานที่ดินให้แก่บริษัท โดยปราศจากขั้นตอนการตรวจสอบ ตามกฏระเบียบประธานาธิบดี PP 10/1961”

และเขายังถามต่ออีกว่า สำนักงานที่ดินแห่งชาติ จังหวัดอาเจะห์ ใช้หลักการอะไรในการออกหนังสือรับรองสัมปทานที่ดิน สำหรับสำนักงานที่ดินอำเภอ มีอำนาจแค่ไหนในการออกใบอนุญาต  ในขณะที่สำนักงานที่ดินอำเภอออกให้ได้แค่ 100 เฮกต้าร์ สำนักงานที่ดินจังหวัดออกให้ได้แค่ 200 เฮกต้าร์ แต่ความจริงได้มีการออกใบอนุญาตไปเป็น 1,000 เฮกต้าร์

                ในปี 2008 เนื่องจากชุมชนมีการประท้วงบ่อยขึ้น บริษัทอูเบอร์ตราโชตัดสินใจแก้ปัญหาโดยการเปลี่ยนชื่อเป็นบริษัทนาฟาซินโด (Nafasindo)ห

                วันจันทร์ที่ 31 เดือนสิงหาคม 2009 ที่ห้องสำนักงานเลขานุการ ชั้น 3 สำนักงานผู้ว่าจังหวัดอาเจะห์ มีการประชุมเพื่อแก้ปัญหาความขัดแย้งที่ดิน โดยมีตัวแทนชาวบ้าน และบริษัทนาฟาซินโด

                การประชุมครั้งถัดไปจะมีขึ้นในวันที่ 17 พฤศจิกายน 2009 ในวาระเดิม ผลการประชุมออกมาว่า การตกลงกันจากทั้งสองฝ่าย เพื่อทำการวัดใหม่ในจุดที่มีปัญหา ถ้าผลออกมาว่าที่ดินดังกล่าวเป็นของบริษัท ทางชุมชนก็จะถอยออกมา แต่ถ้าผลออกมาตรงกันข้าม ทางบริษัทต้องคืนที่ให้ชุมชน

                วันที่ 12 มิถุนายน ถึง วันที่ 26 ตุลาคม 2010 สำนักงานที่ดินแห่งชาติ จังหวัดอาเจะห์ ได้ทำการรังวัดในพื้นที่ตำบลโกตาบาหะรู ซิงโคโฮห์ กูนุงเมเรียะห์ ซิงกิลอุตารา และ ซิงกิล การรังวัดใหม่ครั้งนี้ยึดตามแผนที่ของสำนักงานที่ดินแห่งชาติ จังหวัดอาเจะห์ ผลการรังวัดออกมา พบว่า มีที่ดินของชุมชน 1,997.5 เฮกต้าร์ ซึ่งถูกบริษัทนาฟาซินโดเข้าทำประโยชน์ และยังมีที่ดินที่บริษัทนาฟาซินโด ครอบครองโดยไม่ได้รับอนุญาตอีก 1,158.24 เฮกต้าร์

                วันที่ 28 กุมภาพันธ์ 2011 ผู้ว่าจังหวัดอาเจะห์ อีรวันดี ยูซุฟ (Irwandi Yusuf) ได้ส่งจดหมายเลขที่ No.590/4877 ถึงนายอำเภออาเจะห์ซิงกิล เกี่ยวกับการลงมติความขัดแย้งที่ดินสัมปทานของบริษัทนาฟาซินโด กับชุมชนในอำเภออาเจะห์ซิงกิล ซึ่งเนื้อหาในจดหมาย ผู้ว่าอาเจะห์ได้สั่งการไปยังอำเภออาเจะห์ซิงกิลว่า ให้คืนที่ที่บริษัทนาฟาซินโดเข้าทำประโยชน์ล้ำเขตสัมปทาน และที่ที่บริษัทครอบครองโดยไม่ได้รับอนุญาตให้กับชุมชน พร้อมทั้งดูแลอำนวยความสะดวกให้กับชุมชน และเปลี่ยนหลักแดนจากเดิมที่ทำด้วยมาไม้มาเป็นหลักแดนแบบถาวร และบริษัทต้องออกค่าใช้จ่ายทั้งหมดยกเว้นเฉพาะในพื้นที่ที่ได้รับสัมปทาน

                แต่ขั้นตอนการคืนที่ให้กับชุมชนไม่ได้ราบรื่นและเป็นไปตามจดหมายที่ผู้ว่าอาเจะห์ส่งถึงนายอำเภออาเจะห์ซิงกิล เพราะบริษัทนาฟาซินโด ได้ยื่นฟ้องไปยังศาลปกครองอาเจะห์ ในวันที่ 24 สิงหาคม 2011 และขณะนี้ก็ยังอยู่ในขั้นตอนการขออุทธรณ์ที่ศาลปกครองเมดาน

                แทนที่เรื่องจะจบลงแบบสงบ พลันที่บริษัทยื่นฟ้องผู้ว่าอาเจะห์ ความรุนแรงก็เริ่มขึ้นทันที่ในวันรุ่งขึ้น นักเรียนและชาวบ้านในชุมชนได้ไปประท้วงที่สำนักงานที่ดินแห่งชาติ จังหวัดอาเจะห์ เพื่อต้องการให้มีการจัดการตามที่ผลกระประชุมก่อนหน้านี้ แต่ทุกอย่างกลับเงียบลง ส่งผลให้มีการลอบวางเพลิงที่ว่าการอำเภออาเจะห์ซิงกิล และผู้ประท้วงประมาณ 400 คน ในวันที่ 30 พฤษภาคม 2011ในระหว่างที่มีการประชุมหารือเพื่อดำเนินการไปตามมติในที่ประชุม ทำให้นายอำเภออาเจะห์ซิงกิลยกเลิกการประชุมโดยไม่ได้แจ้งให้ตัวแทนชุมชนทราบ     

จากเหตุการณ์ดังกล่าว ทางเจ้าหน้าที่ตำรวจได้จับกุมผู้ต้องสงสัย 3 คน ซึ่งเป็นแกนนำกลุ่ม คือ Haji Sairun, Jaminuddin และ Rusli Jabat พวกเขาถูกกล่าวหาตามมาตรา 160 และ 170 ของพรบ.ความผิดทางอาญา คดีนี้ถูกตัดสินโดยศาลจังหวัดซิงกิล ให้จำคุก Haji Sairun 7 เดือน ส่วน Rusli Jabat ถูกตัดสินจำคุก 6 เดือน และ Jaminuddin ได้รับปล่อยตัวเพราะผลการพิจารณาคดีไม่มีความผิด ตอนนี้คดียังอยู่ระหว่างการอุทธรณ์ที่ศาลสูงสุด

                ในเหตุการณ์เดียวกันยังมีชาวบ้านอีก 15 คนโดนจับกุม กระบวนการพิจารณาคดีสิ้นสุดที่ศาลจังหวัดซิงกิล 10 คน ถูกกล่าวหาว่าทำลายและเผาสถานที่ตามมาตราที่ 170 วรรค 55 ของพรบ.ความผิดทางอาญา และอีก 5 คนได้รับการปล่อยตัว

                ต่อมา ในวันที่ 22 พฤษภาคม 2012 สำนักงานที่ดินแห่งชาติ จังหวัดอาเจะห์ ได้ลงพื้นที่อำเภออาเจะห์ซิงกิล เพื่อทำการปักหลักแดนถาวร ตามที่เคยตกลงกันระหว่างสำนักงานที่ดินจังหวัดอาเจะห์และหัวหน้าตำรวจอาเจะห์ตามเอกสารหมายเลข No.455/18.11.600/IV/2012 

เวลา 11.30 น. ในวันเดียวกันนั้น เกษตรกรผู้ตกเป็นเหยื่อประมาณ 100 คน ได้เริ่มลงไปในพื้นที่ที่มีความขัดแย้ง กับเจ้าหน้าที่จากสำนักงานที่ดินแห่งชาติ จังหวัดอาเจะห์ เพื่อร่วมรังวัดที่ปักหลักแดน แต่กลับถูกตำรวจจับกุมไปสอบปากคำพร้อมให้เซ็นชื่อรับข้อกล่าวหา และเข้าสู่กระบวนการพิจารณาของศาล ทั้งยังขับไล่ชาวบ้านออกจากพื้นที่ขัดแย้ง

                Sahyani เหยื่อผู้ได้รับผลกระทบให้สัมภาษณ์ผ่านทางโทรศัพท์ว่า ตนถูกตัดสินจำคุกจากกรณีที่ตามไปดูสำนักงานที่ดินแห่งชาติ จังหวัดอาเจะห์ มาทำการปักหลักแดนถาวร ในข้อหาฝ่าฝืนกฏหมายมาตรา 160 พรบ.ความผิดทางอาญา ศาลตัดสินโทษจำคุก 8 เดือน

“หลังจากพ้นโทษ ผมและเพื่อนๆพากันไปขอความช่วยเหลือจากศูนย์ให้ความช่วยเหลือทางกฏหมาย (LBH Banda Aceh) ซึ่งทางศูนย์กฏหมายก็ยินดีให้ความช่วยเหลืออย่างเต็มที่ แม้ว่าสถานะทางเศรษฐกิจจะไม่ค่อยดีและชุมชนเองก็ไม่ค่อยมีความมั่นคง แต่พวกเราขอยืนหยัดต่อสู้ตามสิทธิที่เรามี ตราบใดประเด็นทางด้านกฏหมายและความจริงยังคลุมเคลืออยู่ พวกเราก็จะไม่ยอมถอยเด็ดขาด ความสัมพันธ์ระหว่างบริษัทกับชุมชนเหมือนแมวกับหนู พวกเราโดนจับขังคุก ส่วนบริษัทก็เดินหน้าผลิตปาล์มต่อไป”

                Jamaluddin ถูกตัดสินจำคุก 6 เดือน ในข้อหาเดียวกับ Sahyani ให้สัมภาษณ์ทางโทรศัพท์ว่า แม้ตนจะยากลำบากทั้งทางด้านเศรษฐกิจ และอาจไม่ปลอดภัย แต่ก็ยังมีความมุ่งมั่นเพื่อหาหนทางแก้ไขปัญหาต่อไป จนกว่าจะได้ที่ดินของชุมชนคืนมา ถึงแม้บริษัทจะทำการเพราะปลูกไปแล้วแต่ยังอยู่ในช่วงปรับแก้ใบอนุญาต

“กรณีที่เกิดขึ้นกับชุมชนเรามันนานเกินไป เริ่มตั้งแต่ปี 2006 ในอนาคต เราคาดหวังว่ายังไงบริษัทก็ต้องออกไป เพราะที่ดินที่บริษัทครอบครองอยู่เป็นของชุมชน และพวกเราเองก็ไม่ต้องการให้เกิดความรุนแรง แค่ต้องการใช้สิทธิที่พวกเราพึงมีเท่านั้น”

               

กรณีความขัดแย้งที่เกิดขึ้นที่ในอำเภออาเจะห์ซิงกิล สะท้อนให้เราเห็นว่า บรรดาบริษัทขนาดใหญ่ที่เข้ามายึดพื้นที่ทำแปลงพืชเศรษฐกิจขนาดใหญ่ ทั้งที่อาเจะห์และพื้นที่อื่นๆนั้น ล้วนเป็นผู้ทรงอิทธิพลทางเศรษฐกิจ และการเมือง สามารถเข้าถึงกลไกอำนาจรัฐได้อย่างง่ายดายที่จะอำนวยความสะดวกและผลประโยชน์ให้แก่ตนเอง ขณะที่ชุมชนท้องถิ่นคนพื้นเมืองนั้นก็ตกเป็นฝ่ายถูกกระทำด้วยความเสียเปรียบทุกประการ มีน้อยแห่งที่จะสามารถจัดตั้งตัวเองหรือหาแนวร่วม ขอสนับสนุนจากพันธมิตรทางสังคมเข้ารณรงค์เคลื่อนไหวเรียกร้องความเป็นธรรม หรือแม้กระทั่งการใช้สิทธิ์ทางกฎหมายก็เป็นกระบวนการที่แสนยาก

                และเป็นคำตอบอยู่ในตัวว่าธุรกิจปาล์มน้ำมันเป็นธุรกิจขนาดใหญ่ระดับข้ามชาติ  ผลประโยชน์มหาศาล แต่เป็นผลประโยชน์ที่เกิดขึ้นท่ามกลางการเบียดบังทรัพยากรส่วนรวม ทำลายระบบนิเวศวิทยาของโลก และเติบโตขึ้นพร้อมกับการละเมิดสิทธิชุมชนท้องถิ่นอย่างกว้างขวาง

Controlling land resource by the huge Multinational companies inside the forest area, and creating plantations with the support of authorities in Aceh Province, has resulted in the limitation of local people to utilize the land belonging to them for long. And those people who had long before exploiting the land were kick out from their locality. Things are now much differ from the past in which local people can conveniently utilize the land by the community rules, inherited from the ancestor and the management under traditional customary laws.

There are so many cases that long standing conflict have been brought into the Court. Some other cases had broke out into violence and confrontation ie. the mass protest leading towards destruction  of   properties and  assets. However, reaction by community people and original natives who are there in Aceh did reflect   clearly the impact of policy – bias and also the unjust political, economical   and   social structure   being prevail.

In the province of Aceh only there are 51oil palm companies getting government contracts. Many of them did enjoy the right over land in more than one place, for example only the P.T. Perkebunan Nusantara I alone has contracted in so many plots as much as 13 plots in the whole province. (http://2012.acehinvestment.com/Perusahaan-PMDN.html)

The following story is one example of the confrontation and conflict in Malaysia. The case reflects the conflict

overland  between the community people and the company who gets the contract for oil – palm cultivation in the District of Aceh Singkil ; North of the district is Subulussalam ;South of it is the Pacific Ocean ; Western site is the Province of North Sumatra and the west is the sub- district of Trumon in Aceh Selatan   District. The District of Aceh Singkil has long before been part of Aceh Selatan District. It has been divided under the Act No.14/ 1999 of which nearly the whole area of the Aceh Singkil is located within Gunung Leuser National Park. The area composed of mainland and islands. There are totally 11 Sub – Districts   and 120 villages in the District of Aceh Singkil.

In the mainland of Aceh Singkil there had been contracted for timber production in which the fertile. Wild forest and sea wetland area was unexpectedly transformed and degraded.

At the moment the development of Export – Oriented Agriculture is booming , for example oil palm , cocoa, trees for paper and other cash crops ie. coconut, betel tree, ginger, black tea, cotton, sugarcane , odor herbs and so on. Out of the cultivated cash crops as above – mentioned, oil palm brought the most income into Aceh Singkil since it grows well in the fertile soil and the appropriate climate of the District.

Since it is the new- founding district Aceh Singkil still has a lot of uncultivated land. The company and the government have surveyed all through as to grow cash crops and build up offices in the area which had approved the examination. Most of the companies did utilize the land for oil palm plantations and also the construction of oil palm extraction   factories.

Rusliadi, NGO in Aceh who has been working on community and indigenous people network (Jaringan Komunitas Masyarakat Adat (JKMA Aceh)) mentioned that only in the District Aceh   Singkil   there   are 7 oil palm plantations owned by the companies. He has disclosed informations re the companies and plantations ̕ area in Aceh Singkil as follows:

·   Socfindo company owns the contract over land in Gunung Mariah sub- district 4.414.18 ha and

     4,210 ha of oil palm was cultivated,

·  Lembon Bakit company owns 6,570 ha in Singkil Utara sub – district and 5923 ha being planted

    oil palm,

  ·  Delima Makmur company owns the contract in Danau Paris sub – district of 12,173.47 ha and

      8,969 ha is for oil palm,

  · Ubertraco company owns the contract in Kota Baharu sub-district of 13,924.68 ha and 5,896 ha

      is cultivated,

  ·  Lestari Tunggal Pratama Company owns the contract in Danau Paris of 1,861 ha and 1,200 ha

     is under  oil palm,

  ·  Telaga Zam – zam company owns the contract in Gunung Mariah sub- district of 100.05 ha and

       oil palm is already planted in the whole area,

  ·   Jaya Bahni Utama owns the contract in Danau Paris sub- district of 1,800 ha and the whole area

       is under oil palm.

 

                 In 1986 Ubertraco company owned by Tengki Muslim, villager from Trumon sub- district in the District of Aceh Seratan, had started to cultivate oil palm in Simpang  Kiri sub- district. Anyway, there were some unusual happenings of the case afterwards.

                Later on in 1988 Ubertraco company had received the contract paper No.1/1988 with  the   area of 10, 917 ha in Kota Baharu, Gunugn Meriah, Singkil Utara and Singkil sub- district in the Disfrict of Aceh Singkil. After 6 years, in late 1944, Ubertraco company had recieved  the 2nd contracted paper  No.2/1994 covering 3,000 ha, approx .10 km afar from Kota Baharu and Singkohor sub – district in the District of Aceh Singkil.

In November 10, 1998 Ubertraco Co. had transferred the business to Haji Muhammad Sobri, an enterprenuer from Malaysia. It was reasoned that Ubertraco, while keeping the contract, could not fully start-off both in management set-up and oil palm cultivation, resulted in wasteful land – use for many years.

In 1998 there had been confrontation    between the communities and the Ubertraco over the right on land title   being  coincided with one another . No clear boundary – line among the contracted land and uncultivated  land in which the  former  included the community land .Even there were the construction of the   government office, military  camp,  reservation camp, road   community site   and  so  on  located  in  the  contracted  land  of  the   company.

In 2006 there was the mass movement marching openly in public demanding that the District Council, National Land Bureau and the District office of Aceh Singkil joining together in tackling the arising conflict. Community people put forward the question to Ubertraco that who started to occupy the   community land. They wanted to have a clear border line between the land of the community and that contracted land own by the company.

In 2007 the Provincial Council had invited representative from the affected community and also from the company as to solve the conflicting situation between the community people and Ubertraco through peaceful reconcile. In that meeting the Head of National Land Bureau of Aceh was also invited. Safar Siregar was the representative of the community who did question about how the contract paper being issued to Ubertraco.

                “ Why the National Land Bureau of Aceh Province had issued the contract paper to the company without proper examination process re the Presidential Decree PP10/1961?”

And he further said the National Land Bureau of Aceh Province exercise the case on what ground that issuing of contract paper is possible. Also the District Land Office had what kind of authorized power as to issue the contract paper. In fact the District Land Office could permit any 100 ha maximum and the National Land Bureau of Aceh Province 200 ha. maximum. Surprisingly in practice the government officer had issued the contract paper covering 1,000 ha of land.

In 2008 there were many mass protests as so Ubertraco had decided to resolve the problem by changing its name.  Nafasindo company.

In Monday August 31, 2009 at the secretariat office floor 3 of the Governor of Aceh there were meeting to resolve the conflict on land issue between representative of villagers and that of Nafasindo company.

The next meeting    was scheduled in   November 17, 2009 to discuss the same issue. It was agreed upon to examine the   boundary in every spot of land. If the result of   such examination proof that the land did belong to the company the community people must move out. On the contrary if it proofs the right on land belong to the village people the company must give it back to them.             

                During June 12 to October 26, 2010 the National Land Bureau of Aceh Province had conducted the survey on Land in the sub- district of Kota Baharu, Kunung meriah, Singkil Utara and Singkil. This new survey relied on the standing map of the National Land Bureau of Aceh. As the outcome being found that 1,997.5 ha of community land was utilized by Nafasindo company, and 1,158.24 ha was illegally occupied by the same company.

In February 28, 2011 the Governor of Aceh, Irwandi Yusuf had sent the official letter No. 590 / 4877 to the Administrator of Aceh Singkil informing about the decision on land conflict between Nafasindo and the community people. The said letter was the order of the Governor to the District Administrator at Aceh Singkil that the contracted land and illegal occupied land by the company must be given back to the community and the boundary pole must be changed from the wooden one to the more permanent material. And that the company paid the whole expenses except the one in contracted area.

Anyway the process and procedural steps to give back land to the community is not smooth enough as though the official letter from the Governor of Aceh would instruct the District Administrator of Aceh Singkil clearly, the company “ Nafasindo”  had brought the conflicting case to the Administration Court of Aceh in August 24, 2011. Still now the case had been amended at Administration Court of Medan.

Instead of the conflict would be peacefully ended bringing the case to the Court as mentioned by accusing the Governor of Aceh, violence was likely to break out in the next day. School students together with the community people staged the mass protest in front of the National Land Bureau of Aceh. They demanded that there must be stages of implementing the previous “decisions” accordingly .When nothing happened to respond to the demand there was the fire broke out at the District Office of Aceh Singkil. In May 30, 2011 while 400 protesters were negotiating as how to implement what had been agreed upon previously the District Administrator of Aceh Singkil did cancelled the meeting without giving any notice to community representatives.

As the consequence of such turmoil the Police had arrested 3 core leaders namely Haji  Sairun, Jaminuddin

and Rusli Jabat. The Police accused them based on Criminal Act. No.160 and 170. Finally, the Court of Singkil Province issued the final judgment and gave 7 months penalty for Haji Sairun, 6 months for Rusli Jabat and for Jaminuddin being released since there was no evidence.  At the moment the case had been appealed in the High Court.

Under the same protest event there were 15 villagers being arrested. The Court at Singkil Province issued the judgment that 10 protestors committed the burning and destructing of properties were to be trialed according to the Criminal Act Item 170 paragraph 55, the other 5 villagers were released.

Afterwards in May 22, 2012 the officers from National Land Bureau of Aceh had attempted to locate the exact boundary line by putting permanent poles and undertook field trip to Aceh Singkil. Such follow-up action had been agreed upon between the Provincial Land Office and the Police Head of Aceh as referred to in the document No. 455/18.11.600/IV/2012.   

                At 11.30 AM. of the same day about 100 farmers who conducted the survey for pole – putting together with officers of National Land Bureau of Aceh had been arrested by the police, being investigated and then brought the case to Court as well as forcing the villagers moved out of the conflicting area.

Sahyani a victimized villager gave the phone call interview that his case was only going to observe the officer of the National Land Bureau in putting up the permanent pole and the court decision was to put him in jail for 8 months according to the Criminal Act No.160.

             “Upon being release (after 8 – month penalty)  I and my friends visited the Legal Aid Center in Aceh (LBH Banda Aceh) and the Center was very pleased to help out the case. Though our economic condition is not so good and the community people felt insecure we were willing to stand firmly to fight for our right as long as legal framework and reality was not yet fully clarified. We would not withdraw ourselves for sure. Relations between the company and villagers were somewhat similar to “the cat – and – rat relation”. We, village people were arrested and put in jail when as the company went on producing oil palm.

Jamaluddin got penalty of 6 months jailing under the same charge as of Sahyani. He also gave a phone call interview and did talk about his economic trouble as well as security problem. However he set forth firmly to fight until the land problem be solved and that the community land being given back accordingly. Although the company had already planted oil palm but the status of contract paper was to be extended. He stated as saying.

               “what had happen in the community was too long starting since 2006. In the future we would like the company to move out since the occupied land by the company was truly the community land. We did not wish for violence mean but only to confirm our right straight away.”

Cases of conflict happening in Aceh Singkil District have reflected clearly that all big companies, who took away the land from the community for the cash crop plantation including conflicting cases in the other areas, have tremendous influence both economical and political power. They are capable of mobilizing state power for good service and keeping self- interest, where as the communities and indigenous folks are victimized and gaining   disadvantageous practices  all    the time. Only a few cases that villagers are capable of self- organizing and expanding wider allies and supports from social sector in implementing the campaign for a just society .Legal right and legal assistance is not easily available.

It is there giving answered by itself that the oil palm business is a huge Multinational companies whose interest and wealth have derived from the taken away of public resources as well as destructing global ecology. The accumulated growth exists alongside with the vast violation of community rights in the localities.
