วิบัติภัยและความขัดแย้งใน “ป่าพรุตรีป้า”

กรณีการเปิดพื้นที่ป่าพรุตรีป้าที่จังหวัดอาเจะห์ เพื่อสร้างแปลงพืชเศรษฐกิจขนาดใหญ่อย่างสวนปาล์มน้ำมัน เป็นกรณีศึกษาที่นอกจากจะบอกความอ่อนแอของระบบกฎหมายป่าไม้ของอินโดนีเซียได้อย่างแจ่มชัดแล้ว เรายังเห็นแนวโน้มสำคัญเกี่ยวกับภัยคุกคามที่จะเกิดขึ้นต่อระบบนิเวศป่าเขตร้อนผืนสำคัญของโลกแห่งนี้ พร้อมๆกับความขัดแย้งทางสังคมที่ค่อยๆแผ่ซ่านปกคลุมแผ่นดินอาเจะห์ ที่ปรากฏตัวชัดขึ้น ชัดขึ้น ทุกขณะ

ป่าพรุตรีป้า อยู่ในเขตอำเภอนากันรายา (Nagan Raya) และอำเภออาเจะห์บารัตดายา (Aceh Barat Daya) มีเนื้อที่ทั้งหมดประมาณ 61,803 เฮกต้าร์ ตั้งอยู่ทางปลายแหลมตะวันตกของเกาะสุมาตรา 60% ของป่าพรุตั้งอยู่ในตำบลดารุลมัคมูร์ (Darul Makmur) อำเภอนากันรายา มีประชากรประมาณ 46,954 คน ในตำบลบาบะห์รอท (Babahrot) อำเภออาเจะห์บารัตดายา มีประชากรประมาณ 16,371 คน (BPS,2010)

ป่าพรุแห่งนี้ ตั้งอยู่ใน เขตนิเวศวิทยาเลอูเซอร์ (Leuser Ecosystem) ซึ่งถูกกำหนดให้เป็นพื้นที่ยุทศาสตร์แห่งชาติเพื่อคุ้มครองสิ่งแวดล้อม และในแผนเชิงพื้นที่ของจังหวัดอาเจะห์ ตามกฎหมาย No. 9/1995 ระบุให้ความลึกของป่าพรุตั้งแต่ 3 เมตรขึ้นไปเป็นพื้นที่คุ้มครอง

ตามกฎระเบียบฉบับที่ No.170/kpts-II/2000 ที่รัฐมนตรีว่าการกระทรวงป่าไม้ ประกาศใช้เมื่อวันที่ 29 มิถุนายน 2000 ระบุว่า พื้นที่ป่าในอาเจะห์มีทั้งหมด 5,774,788.92 เฮกต้าร์ โดยแบ่งประเภทของป่าออกเป็นป่าคุ้มครองหรือป่าอนุรักษ์ และป่าไม้เพื่อการผลิต แต่ข้อมูลเหล่านี้ค่อนข้างเก่า เมื่อพบว่าในปัจจุบันข้อมูลขนาดของป่าเปลี่ยนไปเยอะมาก ปัจจุบันรัฐบาลอาเจะห์กำลังเสนอการวางแผนเชิงพื้นที่ และแสดงตัวเลขล่าสุดให้เห็นว่าป่าเหลืออยู่แค่ 3,998,662.45 เฮกต้าร์ ซึ่งแสดงให้เห็นว่าจำนวนพื้นที่ป่าลดลงอย่างชัดเจน และหนึ่งในจำนวนป่าไม้ที่เหลืออยู่นั้นและกำลังถูกคุกคาม ก็คือป่าพรุตรีป้านั่นเอง

Teuku Muhammad Zulfikar ให้ข้อมูลว่า ป่าพรุตรีป้าได้ประสบความเสียหายจากการเปิดและเคลียร์พื้นที่จากบริษัทปาล์มน้ำมัน และการบุกรุกของคนท้องถิ่น จากการประเมินล่าสุดป่าไม้ในพื้นที่ป่าพรุตรีป้าเหลือน้อยกว่า 50% ของทั้งหมดจากประมาณ 61,803 เฮกต้าร์ และพื้นที่ 36,185 เฮกต้าร์ กลายมาเป็นพื้นที่สัมปทาน โดย 4 บริษัทน้ำมันปาล์มยักษ์ใหญ่ คือ บริษัทซูร์ยาพาเนินซูบูร์ (Surya Panen Subur หรือ SPS)  เนื้อที่สัมปทาน 13,177 เฮกต้าร์ บริษัทคาลิสตาอาลัม (Kalista Alam) เนื้อที่สัมปทาน 6,888 เฮกต้าร์ บริษัทเกอโลราซาวิตามัคมูร์ (Gelora Sawita Makmur) เนื้อที่สัมปทาน 8,604 เฮกต้าร์ และบริษัทเจอเมอร์ลังอาบาดี (Cemerlang Abadi) เนื้อที่สัมปทาน 7,516 เฮกต้าร์ ซึ่งจากการให้สัมปทานทั้งหมด พื้นที่ถูกเปิดเรียบร้อยแล้ว 20,200 เฮกต้าร์ แต่ยังอยู่ในการเริ่มระยะแรกและระยะที่สอง

ป่าพรุตรีป้าเป็นพื้นที่ที่รุ่มรวยไปและหลากหลายไปด้วยทรัพยากรธรรมชาติ มีทั้งพืชและสัตว์ รวมไปถึงผลิตภัณฑ์จากป่า ที่คนพื้นเมืองในชุมชนนำมาสร้างรายได้ ป่าพรุเป็นแหล่งที่อยู่อาศัยของพืชและสัตว์ที่ดีที่สุด และทั้งพืชและสัตว์มีมูลค่าทางเศรษฐกิจสูง

“เฉพาะในพื้นที่ป่าพรุตรีป้า มีสัตว์น้ำอย่างต่ำ 40 สายพันธุ์ที่สำคัญทางเศรษฐกิจ เช่นปลาดุก ปลาช่อน ปลาไหล หอย ฯลฯ นอกจากนี้ยังมีไม้สำหรับก่อสร้างและเชื้อเพลิง รวมถึงความหลากหลายของสัตว์ป่า อุรังอุตัง งูเหลือม เสือสุมาตรา จระเข้ นกขนาดใหญ่ ผึ้งป่า” Teuku Muhammad Zulfikar ให้ข้อมูลเพิ่มเติม

นอกจากนี้ ป่าพรุตรีป้าถูกกำหนดให้เป็นพื้นที่พิเศษสำหรับการอนุรักษ์อุรังอุตัง โดย Great Apes Survival Partnership (GRASP) ร่วมกับองค์กรด้านสิ่งแวดล้อมของสหประชาชาติ (United Nations for Environment Programme (UNEP)) และ Unessco ระบุว่า ถ้าป่าพรุตรีป้าเติบโตตามปกติ พื้นที่นี้ก็จะเป็นที่อยู่ของประชากรอุรังอุตังประมาณ 1,000 ตัว ซึ่งเป็นประชากรที่มากที่สุดของโลก

“ป่าพรุตรีป้ามีความสำคัญมากทางระบบนิเวศน์ มีหน้าที่ในการป้องกันคลื่นยักษ์สึนามิ มีหน้าที่ในการรีไซเคิลน้ำ และป้องกันน้ำท่วม เป็นแหล่งตรึงและสะสมก๊าซคาร์บอนไดอ๊อกไซด์ และยังเป็นพื้นที่ที่มีความหลากหลายทางชีวภาพ”

กระบวนการเปิดป่าเพื่อปลูกพืชเศรษฐกิจในป่าพรุตรีป้า เป็นสาเหตุหนึ่งในการทำลายป่าพรุตรีป้า ทำให้สูญเสียระบบนิเวศ และเกิดภัยพิบัติมากขึ้นต่อชุมชน เช่น สึนามิ น้ำท่วม ภาวะแห้งแล้ง ความขาดแคลนน้ำจืด และแหล่งอาหาร

 การเสียสมดุลทางธรรมชาติ ทำให้ในฤดูฝนเกิดน้ำไหลบ่าท่วมจนกลายเป็นอุทกภัยสร้างความเสียหายแก่หมู่บ้านรอบๆ ป่าพรุ และเมือถึงฤดูแล้งก็เกิดความแห้งแล้งสุดๆ

 “สาเหตุที่ป่าเกิดความแห้งแล้งนั้น เกิดจากการขุดคลองของบริษัทที่ได้รับสัมปทาน เพื่อระบายน้ำออกจากป่า อีกทั้งการเคลียร์พื้นที่ของบริษัทโดยการเผาป่าบ่อยๆ สิ่งเหล่านี้เป็นการทำลายป่าพรุที่รุนแรงที่สุด”

การทำลายป่าพรุก็คือการทำลายแนวกั้นสึนามิ ป่าพรุตรีป้าเปรียบเสมือนแนวกั้นธรรมชาติ กำแพงธรรมชาติ จากเหตุการณ์สึนามิเมื่อปี 2004 ป่าพรุตรีป้าสามารถปกป้องคนและชุมชนที่อยู่ด้านหลังป่าพรุไว้ได้ ถึงแม้สึนามิทำความเสียหายให้แก่ป่าพรุบ้าง ถึงกระนั้นป่าพรุก็สามารถปกป้องคนในอำเภอนากันราย และอำเภออาเจะห์บารัตดายาไว้ได้มากมาย

การสูญเสียที่กักเก็บก๊าซคาร์บอนไดออกไซด์ เพราะกิจกรรมการปลูกพืชเศรษฐกิจปาล์มน้ำมัน ต้องแปรสภาพของป่าเพื่อให้พร้อมสำหรับการเพาะปลูก ซึ่งเป็นสาเหตุของความเสื่อมโทรมของป่า ทั้งที่มาจากการระบายน้ำออก จากการเผา กิจกรรมเหล่านี้นำไปสู่การปล่อยก๊าซคาร์บอนไดออกไซด์ ในขณะที่ป่าพรุเป็นแหล่งกักเก็บก๊าซคาร์บอนไดออกไซด์ชั้นดี

Teuku Muhammad Zulfikar พูดเน้นประเด็นการทำลายแหล่งกักเก็บคาร์บอนไดอ๊อกไซด์ที่กำลังเป็นเรื่องอื้อฉาวในระดับนานาชาติว่า รัฐบาลประกาศต่อนานาชาติว่า อินโดนีเซียมีแหล่งกักเก็บคาร์บอนจำนวนมากมาย แต่ความจริงกับตรงกันข้าม เพราะรัฐบาลเปิดให้สัมปทานป่าพรุจำนวนมาก ทำให้มีการทำลายแหล่งกักเก็บคาร์บอนอยากรวดเร็ว ส่งผลให้แหล่งกักเก็บคาร์บอนเหลือน้อยลง

“การทรุดตัวลงของดิน ภายใน 20 ปีข้างหน้า ป่าพรุตรีป้าจะเกิดการทรุดตัวลง 1 เมตรหรือมากกว่านั้น สิ่งที่เกิดขึ้นสามารถทำนายได้ล่วงหน้าว่า พื้นที่บางส่วนของอำเภอนากันรายา โดยเฉพาะที่ตำบลดารุลมัคมูร์ และตำบลบาบะห์รอท จะเกิดน้ำท่วมถี่ๆและง่ายขึ้น เพราะว่าพื้นดินทรุดตัวต่ำลงกว่าระดับน้ำทะเล”

ในด้านผลกระทบทางด้านสังคมจากการเข้ามาใช้พื้นที่ของบริษัทพืชเศรษฐกิจปาล์มน้ำมันในป่าพรุตรีป้านั้น มีตั้งแต่การสูญเสียที่ทำกินและแหล่งเก็บเกี่ยวผลผลิตจากป่าธรรมชาติ ป่าพรุตรีป้ามีความสำคัญมากต่อเศรษฐกิจของคนในท้องถิ่น ซึ่งส่วนใหญ่เป็นเกษตรกร ชาวประมง แรงงานและรับจ้างทั่วไป มีคนเพียงน้อยนิดเท่านั้นที่เป็นลูกจ้างของรัฐหรือเจ้าของธุรกิจพืชเศรษฐกิจ และที่โชคร้ายไปกว่านั้น แหล่งที่อยู่อาศัยของชาวชุมชนท้องถิ่นยังตกอยู่ในอันตราย

การปรากฏตัวของสวนปาล์มน้ำมันในป่าพรุตรีป้า ส่งผลให้เกิดความขัดแย้งเรื่องที่ดินระหว่างชุมชนกับบริษัทปาล์มน้ำมัน เช่น ที่หมู่บ้านคัวลาเซอมายัม (Kuala Semayam) ซึ่งเป็นพื้นที่ที่อยู่ระหว่างการสัมปทานของบริษัทปาล์มน้ำมัน และที่ดินเหล่านั้นเป็นที่ดินจากบรรพบุรุษของเขา แต่ถูกบริษัทยึดครองไปแล้ว

     จากการสังเกตการณ์ประเด็นป่าไม้ของ Afrizal Akmal นักกิจกรรมและเคลื่อนไหวจากองค์กรพัฒนาเอกชนแห่งหนึ่ง พบว่า ถึงแม้การขยายตัวออกของบริษัทพืชเศรษฐกิจปาล์มน้ำมัน จะมีพลังในทางเศรษฐกิจ เพราะสามารถแก้ปัญหาการว่างงานและความยากจนในอาเจะห์ สิ่งเหล่านี้ไม่สามารถอธิบายให้เข้าใจได้ทั้งหมดโดยตรรกะต่างๆในเวลาเพียงชั่วข้ามปีของการปลูกปาล์มน้ำมัน ในความจริงมันเป็นการทำให้เกิดผลกระทบอย่างมหันต์ต่อความหลากหลายทางชีวภาพในพื้นที่ชุ่มน้ำ และสำหรับคนในท้องถิ่น ระบบการปลูกพืชเศรษฐกิจปาล์มน้ำมันขนาดใหญ่เช่นนี้ เป็นระบบหนึ่งที่ทำลายเศรษฐกิจท้องถิ่น และวัฒนธรรมชุมชน

การรุกเข้ามาของนักลงทุนทั้งในและต่างประเทศในธุรกิจสร้างแปลงพืชเศรษฐกิจขนาดใหญ่ที่อาเจะห์นี้ อาจไม่ต่างกับชาติมหาอำนาจยกทัพเข้ายึดเมืองขึ้นในสมัยก่อน เพียงแต่ใช้อาวุธที่แตกต่างออกไป ได้ก่อให้เกิดความขัดแย้งขึ้นทุกระดับ ตั้งแต่ระหว่างบริษัทกับชุมชนท้องถิ่น บริษัทกับหน่วยงานรัฐ ชุมชนท้องถิ่นกับหน่วยงานรัฐ บริษัทกับองค์กรทางสังคมที่ทำหน้าที่ตรวจสอบ

วาลฮีอาเจะห์ได้บันทึกความขัดแย้งที่อยู่ในกระบวนการยุติธรรม คดีที่เกี่ยวแก่การกระทำที่เกิดขึ้นที่ป่าพรุตรีป้า จำนวน 8 คดี ดังนี้ (จากแฟ้มข้อมูลของ วาลฮี อาเจะห์)

1.บริษัทคาลิสตาอาลัม (Kalista Alam) ขออุทธรณ์ต่อศาลปกครองสูงสุดที่จาการ์ต้า จากกรณีที่วาลฮีอาเจะห์ (Walhi Aceh ) เรียกร้องให้ผู้ว่าอาเจะห์ยกเลิกใบอนุญาตปลูกพืชเศรษฐกิจปาล์มน้ำมันที่ออกโดยผู้ว่าอาเจะห์ No.525/BP2T/5322/2011 เมื่อวันที่ 25 สิงหาคม 2011 ซึ่งเป็นใบอนุญาตให้ทำธุรกิจเพาะปลูกพืชเศรษฐกิจ แก่บริษัทคาลิสตาอาลัม ในหมู่บ้านพูเลครูเอท (Pule Village Kruet) ตำบลดารุลมัคมูร์ (Darul Makmur) อำเภอนากันรายา (Nagan Raya) จังหวัดอาเจะห์ ตอนนี้คดีความอยู่ที่ศาลปกครองสูงสุดที่จาการ์ต้า

2.บริษัทคาลิสตาอาลัม (Kalista Alam) ยื่นฟ้องผู้ว่าอาเจะห์ที่ศาลปกครองอาเจะห์ กรณีผู้ว่าอาเจะห์ยกเลิกใบอนุญาต No.525/BP2T/5322/2011 เมื่อวันที่ 25 สิงหาคม 2011 ซึ่งเป็นใบอนุญาตให้ทำธุรกิจเพาะปลูกพืชเศรษฐกิจ แก่บริษัทคาลิสตาอาลัม ในหมู่บ้านพูเลครูเอท (Pule Village Kruet) ตำบลดารุลมัคมูร์ (Darul Makmur) อำเภอนากันรายา (Nagan Raya) จังหวัดอาเจะห์ ผู้ว่าอาเจะห์ขออุทธรณ์ต่อศาลปกครองเมดาน

3.คดีแพ่ง กระทรวงสิ่งแวดล้อมฟ้องบริษัทคาลิสตาอาลัม (Kalista Alam) กรณีเคลียร์พื้นที่โดยการเผาป่าแบบผิดกฎหมายในป่าพรุตรีป้า อำเภอนากันรายา (Nagan Raya) คดีนี้เข้าสู่กระบวนการพิจารณาในชั้นศาลแล้ว ที่ศาลจังหวัดเมอลาโบห์ (Meulaboh) อำเภออาเจะห์บารัต (Aceh Barat)

4.คดีอาญา กระทรวงสิ่งแวดล้อมฟ้องบริษัทคาลิสตาอาลัม (Kalista Alam) กรณีเคลียร์พื้นที่โดยการเผาป่าแบบผิดกฎหมายในป่าพรุตรีป้า อำเภอนากันรายา (Nagan Raya) คดีนี้จะพิจารณาที่ศาลจังหวัดเมอลาโบห์ (Meulaboh) อำเภออาเจะห์บารัต (Aceh Barat) ในเวลาใกล้เคียงกันนี้ และอัยการศาลMeulaboh เป็นผู้ฟ้องร้อง

5.คดีแพ่ง กระทรวงสิ่งแวดล้อมฟ้องบริษัทซูร์ยาพาเนินซูบูร์2 (Surya Panen Subur II) กรณีเคลียร์พื้นที่โดยการเผาป่าแบบผิดกฎหมายในป่าพรุตรีป้า อำเภอนากันราย (Nagan Raya) กรณีนี้จะพิจารณาที่ศาลจังหวัดจาการ์ต้าตะวันออก (Jakarta Timur)

6.คดีอาญา กระทรวงสิ่งแวดล้อมฟ้องบริษัทซูร์ยาพาเนินซูบูร์2 (Surya Panen Subur II) กรณีเคลียร์พื้นที่โดยการเผาป่าแบบผิดกฎหมายในป่าพรุตรีป้า อำเภอนากันรายา (Nagan Raya) กรณีนี้จะพิจารณาที่ศาลจังหวัดจาการ์ต้าตัวีนออก (Jakarta Timur)

7.ชุมชนรอบป่าพรุตรีป้า แจ้งความต่อผู้ว่าอาเจะห์ กรณีถูกกล่าวหาว่าฝ่าฝืนกฎแผนพัฒนาเชิงพื้นที่อาเจะห์ โดยรายงานไปที่กองบัญชาการตำรวจอินโดนีเซียที่จาการ์ต้า แต่ยังไม่มีความคืบหน้า

8.เครือข่ายปกป้องป่าพรุตรีป้า แจ้งความต่อตำรวจที่สถานีตำรวจเมืองบันดาอาเจะห์ ข้อหาที่นายมูฮัมหมัด ยะห์ยา ( Muhammad Yahya) หัวหน้าสำนักงานออกใบอนุญาต โดยกล่าวหาว่า ปลอมแปลงข้อมูล ให้ข้อมูลเท็จเกี่ยวกับป่าไม้ในป่าพรุตรีป้า ถึงตอนนี้ ยังไม่มีความคืบหน้าใดๆ

คดีเหล่านี้ เป็นข้อแสดงให้เห็นว่า ผู้ประกอบการหรือนายทุนนั้นได้ใช้ช่องว่างทางกฎหมายในการเข้ากระทำการ ในขณะที่ระเบียบกฎหมายที่ดินป่าไม้และกลไกรัฐก็ยังไม่สามารถตามทันกลเกมของนักลงทุนได้ ฝ่ายองค์การสาธารณะประโยชน์ที่จะทำหน้าที่ตรวจสอบการกระทำที่มิชอบของบริษัทและตรวจสอบการใช้อำนาจรัฐก็มีบทบาทอันจำกัด มิพักต้องกล่าวถึงพลังของชุมชนท้องถิ่นผู้ที่ประสบผลกระทบโดยตรงและรุนแรงที่สุด ที่ยังขาดประสบการณ์ทางการจัดตั้งเพื่อต่อสู้ต่อรองและตรวจสอบความมิชอบมาพากลในกระบวนการของการลงทุนขนาดใหญ่

ดูคล้ายกับว่ากรณีปัญหาการทำลาย ป่าพรุตรีป้า ที่ได้ถูกนำเข้าสู่กระบวนการยุติธรรมนั้น กฎหมายสิ่งแวดล้อมได้ถูกนำมาใช้อย่างจริงจังบ้างแล้ว แต่ยังไม่สามารถคาดผลใดได้ เพราะในกระบวนการยุติธรรมยังมีความยืดเยื้อ บางกรณีถูกแช่แข็งไม่มีความคืบหน้า มีเล่ห์หนกลเกมทางกฎหมายมากมาย กว่าจะมีการตัดสินคดี  ในภาคปฏิบัติจริงผู้ประกอบการอาจใช้พื้นที่เพาะปลูกให้ผลผลิตถอนทุนคืนไปแล้วมหาศาลและพร้อมที่จะจ่ายค่าปรับจำนวนน้อยนิด

พร้อมกับทิ้งความบอบช้ำไว้แก่นิเวศป่าและชาวชุมชนท้องถิ่นแห่งอาเจะห์

Disaster and Conflict Disputes Based in “Tripa Swamp Forest”

 

In order to invest large lands for palm trees plantation, Tripa Swamp Forest, where is located in Aceh Province, have been approached and cleared for operation stage. Accordingly, there are best practices to be learned in terms of clearly weakness of Indonesian forestry regulations and it must be addressing. Moreover, threads tendency of core tropical forestry ecology systems have been projected. Obviously, continuous occurred social conflict disputes have been slightly spreading across Aceh’s lands.

Regarding Tripa Swamp Forest, it is located in both Nagan Raya District and Aceh Barat Daya District. Total forest areas are approximately 61,803 hectares and it is grounded in the West of Sumatra Island. In addition, 60% of swamp forest is based in Darul Makmur Sub-District in Nagan Raya District. Its total population is 46,954 people, residence in Babahrot Sub-District and 16,371 people residence in Aceh Barat Daya District (BPS, 2010).

In fact, particular area is located in Leuser Ecosystem Zone, where environmental conservation has been established in national strategic areas. It is also a spatial development plan of Aceh province according to document No. 9/1995. Particular conservation areas has been scoping at least three meters in length onward boundary.

According to Ministry of Forestry, regulation No.170/kpts-II/2000 has been declared on June 29, 2000. It shows total forest areas in Aceh Province as 5,774,788.92 hectares, and classified as conservation and production areas. Currently, forest boundary has completely changed up to date. In contrast, remaining forest areas figure is seen as 3,998,662.45 hectares according to spatial development plan, which the Aceh’s government approved. Obviously, total forest areas have continuing declined as same as Tripa Swamp Forest has been endangered.

Teuku Muhammad Zulfikar informed that Tripa Swamp Forest were damaged from opening and clearing concession lands by palm trees plantation company as same as encroached by local people.  In fact, Tripa Swamp Forest total areas have found less than 50% of total forest areas or 61,803 hectares. Interestingly, the concession lands have been relocated to four huge palm trees companies, it approximates as 6,185 hectares. Firstly, palm trees plantation company namely Surya Panen Subur or SPS Company has possessed lands as 13,177 hectares. Secondly, Kalista Alam Company occupied lands as 6,888 hectares. Thirdly, Gelora Sawita Makmur Company has lands concession as 8,604 hectares. Last but not least, Cemerlang Abadi Company has accessed over areas as 7,516 hectares. Total lands concession were completely opened and cleared for operation stage (first and second stage) of plantation as seen by 20,200 hectares.  

Tripa Swamp Forest is well-known as fruitful lands with abundant biodiversity. Many various valuable species likely plants, animals, and non-timber products exist, where local people’ incomes can thoroughly be generating.  

“Particular Tripa Swamp Forest, there are at least 40 economically aquatic species such as catfishes, snake-head fishes, eels, and snails. Moreover, there are some species timbers  for construction and fuel energy and some diversified wild animals as orangutan, boa constrictor, Sumatra tigers, crocodiles, wild-bees, and giant birds.”, detailed added by Teuku Muhammad Zulfikar.

Moreover, based on projection, if Tripa Swamp Forest is significantly growing, 1,000 orangutan populations will be grounded. As the results,  particular areas have been targeted to become specific land for orangutan conservation by Great Apes Survival Partnership (GRASP) together with United Nations for Environment Programme (UNEP)) and The UNESSCO.  

“Regarding Tripa Swamp Forest, it plays important roles for ecology systems in terms of being buffer zone from giant waves as tsunami, water recycling, and flooding protection, carbon dioxide pull and sink, including biodiversity survival.”

However, lands clearing processes for cash crops plantation is a key factor to deforestation, ecological destruction, and natural disaster impacts.  Accordingly, tsunami, floods, drought, water shortage, and food insecurity would directly affect to surrounding communities.

“While natural non-equilibrium happens, surrounding communities encounter with flood damages as well as drought crisis.”

 “In fact, digging cannel along planted areas to drain out some water and firing some forestry for lands clearing and operating are key factors to drought crisis, which definitely call forest destruction. ”

Regarding swamp forest, where natural barrier has been built up, is buffer areas for disaster arriving as giant waves as tsunami, which taken place last 2004. Even through some swamp forestry has been destroyed, surrounding communities and people in Nagan Raya District and Aceh Barat Daya District have been protected.

Regarding palm trees plantation business, it causes lands lost and ruins forestry, where carbon dioxide is being pulled and sink. In fact, plantation preparedness needs large lands clearing and operating, leading to deforestation. Besides, activities such as draining water out of forest and burning lands lead carbon dioxide emission emerging while growing swamp forest leads carbon dioxide gases keeping and sinking.

Teuku Muhammad Zulfikar stressed that losing areas of carbon dioxide pulls and sinks has been well-addressing at world-wide stage. In this case, Indonesian government has declared as carbon dioxide sink and pull sources are fully exist in Indonesia. In fact, lands concession cause swamp forestry rapidly changed, endangered, and destructed across country. Eventually carbon dioxide sinks and pulls areas have been fewer remains, ashamed Indonesian government.

“Over next 20 years, lands will have been subsided and Tripa Swamp Forest also be shrink into one meter in depth or more than that. Based on assumption, some areas of Nagan Raya District particular in Darul Makmur Sub-District and Babahrot Sub-District will simply often flood due to lower sea level.

Regarding social aspect, lands use and source of incomes generating derived from forest products, have been lost. In fact, swamp forest is worthy for communities likely domestic economic as farming, fishery, labor forces and general employed.   Despite few group of people as government officers, companies’ employees benefiting by cash crops business, unfortunately, local people dwelling has been endangered.   

Appearance of palm trees plantation in Tripa Swamp Forest causes conflict disputes over lands ownerships between locality and companies. In fact, Kuala Semayam Village, where is local residence and ancient lands have been relocated to palm company instead.  

     Based on observation of forestry movement, activist who works for NGOs namely Afrizal Akmal found that. Even through greater expansion of palm trees plantation possessed economic power to fill poverty’s gaps and unemployment situation in Aceh Province, logical explanation on negative phenomena on palm trees plantation is unreasonable. Actually, severe impacts on biodiversity based in watershed areas and local residence lead to collapsed domestic economic and culture.  

General speaking, both domestic and foreign investors on large cash-crops plantations might not be invasive as same as influential colonialism in the past. Differentiates is that colonizing used arm and weapons to invade, investors use conflict disputing over lands use at all levels to infest. Obviously, conflict between company and local communities, company and local government, communities and government, as well as companies and watch organizations, are taking places.

In fact, conflict disputes directly related to Tripa Swamp Forest have been recorded by WALHI Aceh. There are eight cases of existing juristic processes according to WALHI Aceh records as present below.

1. The Kalista Alam Company has proposed to Supreme Administrative Court in Jakarta accordance with WALHI Aceh demanding the governor of Aceh Province to cancel palm trees   plantation license, which Aceh’s governor approved. It accordingly refers to document No.525/BP2T/5322/2011, issued on August 25, 2011. Firm namely Kalista Alam Company is  allowed to operate cash-crops plantation, where is located in Pule Village, and  Kruet Village, Darul Makmur Sub-district, Nagan Raya District, in Aceh Province. As the results, the case has been in administration processing at Supreme Administrative Court based in Jakarta.

2. Kalista Alam Company also has sued the governor of Aceh Province, which implementing at Aceh’s Administrative Court. In this case, the company has been canceled its license according to document No.525/BP2T/5322/2011, issued on August 25, 2011 by the governor. This license is allowed the Kalista Alam Company to conduct business cash-crops plantation, where is located in Pule Village Kruet Village, Darul Makmur Sub-District, Nagan Raya District, in Aceh Province. Eventually, the governor is now being proposed to Medan’ Administrative Court for defenses.  

3. Regarding civil case, the Ministry of Environment sues Kalista Alam Company in case of law violation due to lands fired clearing across Tripa Swamp Forest areas, where is located in Nagan Raya District. This case is now on processing in Meulaboh Provincial Court, Aceh Barat District.

4. Consideration, criminal case, the Ministry of Environment sues Kalista Alam Company in case of law violation due to lands fired clearing across Tripa Swamp Forest areas, located in Nagan Raya District. This case will be processing in Meulaboh Provincial Court, Aceh Barat District and the judge will be as plaintiff accordingly.

5. Regarding civil case, the Ministry of Environment sues Surya Panen Subur II Company in case of law violation due to lands fired clearing across Tripa Swamp Forest areas, located in Nagan Raya District. This case will be determining in Jakarta Timur Provincial Court.

6. Consideration, criminal case, the Ministry of Environment sues Surya Panen Subur II Company in case of law violation due to lands fired clearing across Tripa Swamp Forest areas, located in Nagan Raya District. This case will be determining in Jakarta Timur Provincial Court.

7. Surrounding communities of Tripa Swamp Forest has sued the governor of Aceh Province as being accused to regulations break regarding Aceh’s spatial development plan. It has been reporting to Indonesian Police Headquarter in Jakarta. Seriously, it seems nothing to be progressive.

8. Tripa Swamp Forest conservation network has notified to police man in Aceh Barat District at police station. In this case, Muhammad Yahya, deputy of provincial license approval office is imparted as he did artificial documents, and informed untruth information about Tripa Fresh Swamp Forest. In fact, there is nothing ongoing. 

All of cases show that companies or investors have taken advantages through using gaps of law while forestry and lands regulations as well as government mechanism not capable to deal with firms’ tactics. To be considering, social organizations with full of responsibilities to watch and check misbehave firms and government agencies, has limited power to exercise. Regarding powerful communities, where impacts are rapidly directed on, still lag of movement experiences set up in terms of protesting, struggling, demands, and negotiation accordance with mal-mega projects investment processes.

It seems that deforestation in Tripa Swamp Forest has been implementing into juridical methods. Although some particular environment law has been exercised, unexpected results still remain due to long terms implementation in justice processes. In fact, frozen cases are undertaking, many tactics of law are being played until final determination made. Nonetheless, while the courts are processing cases, companies are approaching more productive, greater benefits return, and eventually ready to pay a few fine fees.

Only degraded communities, destructed forestry ecology systems, and affected surrounding people have been remaining behind in Aceh.
